    The District Engineer, U.S. Army Engineer District, Omaha, Nebraska is evaluating a mitigation banking site plan (Gretna Bottom 2) under Lyman-Richey Corporation (LRC) existing umbrella instrument. Mitigation banks are used to satisfy compensatory mitigation requirements for permits issued under the authority of Section 404 of the Clean Water Act, which regulates the discharge of dredged or fill material in the nation’s waters. The purpose of this notice is to inform interested parties of the proposed mitigation bank and to solicit comments. Participation is encouraged, so that the U.S. Corps of Engineers is better able to complete a more thorough public interest review. Comments assist the District Engineer to make a reasonable decision based on public interest factors. The Gretna Bottom 2 Wetland Mitigation Bank Site is located in Section 9, Township 13 North, Range 10 East in Sarpy County, Nebraska, specifically, 41.108551, -96.308425 (Center of site). Currently, the Gretna Bottom 2 project site is approximately 52.60 acres. The site was delineated in 2017 and does not contain existing wetlands.

    The District Engineer has received a prospectus from the Sponsor titled, “Prospectus - Bruce Mitigation Bank”, hereon referred to as the Prospectus. The Corps is soliciting comments on the Prospectus. The Prospectus described herein is not being proposed by the Corps, but by the Sponsor. The Corps will evaluate the Prospectus according to the requirements of the Mitigation Rule (33 CFR 332) to determine if the Prospectus has the potential to produce compensatory mitigation suitable to offset unavoidable impacts to waters of the United States authorized through the issuance of Department of the Army (DA) permits pursuant to section 404 of the Clean Water Act (33 U.S.C. 1344) and/or sections 9 or 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 401, 403). The proposed project (Mitigation Site) is located at Latitude 44.512328°, Longitude - 96.970147°; in Brookings County, South Dakota.
