    The District Engineer has received a prospectus from the Sponsor (Tetonka, LLP) titled, “Prospectus - Little Coulee Mitigation Bank”, hereon referred to as the Prospectus. The Corps is soliciting comments on the Prospectus. The Prospectus described herein is not being proposed by the Corps, but by the Sponsor. The Corps will evaluate the Prospectus according to the requirements of the Mitigation Rule (33 CFR 332) to determine if the Prospectus has the potential to produce compensatory mitigation suitable to offset unavoidable impacts to waters of the United States authorized through the issuance of Department of the Army (DA) permits pursuant to section 404 of the Clean Water Act (33 U.S.C. 1344) and/or sections 9 or 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 401, 403). The Sponsor is proposing to develop a compensatory mitigation site within the Red River/Minnesota River geographic service area (GSA). If approved, the Mitigation Site would produce credits available to offset the loss of waters of the United States within the GSA. The Sponsor proposes to restore an intermittent stream channel and adjacent wetlands.

(DU), to add the Cass County Site to their North Dakota Umbrella Mitigation Banking Instrument approved June 21, 2019. The site is located 3 miles northeast of Ayr, North Dakota in the NW¼ of Section312, Township 142 North, Range 53 West at Latitude 47.075767° North, Longitude -97.446082° West, Cass County, North Dakota. DU estimates the 115-acre site would yield 74.8 credits upon plan implementation. Credits would be used to satisfy compensatory mitigation requirements for aquatic resource impacts in the Red River Valley Regional Service Area that are permitted by the Corps or by other Federal, state, or local agencies with similar requirements.

The site is located 3 miles north of Woodworth, North Dakota in the NW¼ of Section 22, Township 143 North, Range 68 West at Latitude 47.193558° North, Longitude -99.286330° West, Stutsman County, North Dakota. DU estimates the 160-acre site would yield 47.96 credits upon plan implementation. Credits would be used to satisfy compensatory mitigation requirements for aquatic resource impacts in the Missouri River South Regional Service Area that are permitted by the Corps or by other Federal, state, or local agencies with similar requirements.

    Flatwater Lake Estates, LLC proposes to convert a reclaimed sand and gravel operation into a private residential lake with lots platted single family homes. The proposed project involves the construction of a lakefront residential development next to an inactive sand and gravel pit. The authorization of this project will include grading and excavation for residential lots, paved roads, sidewalks, entrances, water, sanitary, and sewer lines. The development will be designed to accommodate approximately 106 residences.

    Western Sand and Gravel Company (WS&G) is proposing to expand and continue to mine sand and gravel at the Louisville sand and gravel mine. WS&G is proposing to mine the 174-acre site in six phases over 28 years. Phase 1 would occur in the north portion of the parcel, adjacent to the existing Louisville Mine mining operations. Phase 2 would continue mining to the north of Phase 1. Phase 3 would extend south of Phase 1, adjacent to the existing Louisville Mine mining operations. Phase 4 would continue mining to the west of Phase 3, Phase 1, and Phase 2. Phase 5 would extend west of Phase 4. Phase 6 would extend west of Phase 5.
