    The District Engineer is evaluating a permit application from the North Dakota Department of Transportation for reconstruction of 11.6 miles of North Dakota Highway 1804 (1804), County Road 42 (123rd Avenue NW) to the junction 17A, which would result in permanent impacts to approximately 1.69 acres of waters of the United States, including wetlands. The project is located in Sections 12, 14, 15 and 17 of Township 154 North, Range 98 West and Sections 7 and 15, Township 154 North, Range 97 West, all in Williams County.   • Special Public Notice for Federal Register Notice

    On January 6, 2017, the U.S. Army Corps of Engineers (Corps) published the notice in the Federal Register announcing the reissuance of all existing nationwide permits (NWPs), general conditions, and definitions with some modifications. The NWPs became effective on March 19, 2017, and will expire on March 18, 2022.

    The District Engineer is reviewing a request from the City of Bismarck to modify a stormwater development permit issued on April 10, 2018. Upon receipt of final plans prior to commencement of construction, it was noted that there was a misinterpretation of a discussion about avoidance and incorporation of existing wildlife impoundments into the plan. The City proposes to replace the impoundments with engineered detention ponds, which increases permitted impacts from 4.23 acres to 12.52 acres. The City provided a revised mitigation plan for consideration. The project is located in northwest Bismarck, North Dakota in the NE¼ of Section 17, Township 139 North, Range 80 West, Burleigh County [Latitude 46.863237° North, Longitude -100.788299° West].
