    The Omaha District of the U.S. Army Corps of Engineers (Corps) has received an application for a Department of the Army permit pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344) and/or Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. §403). This public notice is issued jointly with the Nebraska Department of Environment and Energy (NDEE), 245 Fallbrook Blvd, Lincoln, NE 68521. NDEE will review the proposed project for state certification in accordance with the provisions of Section 401 of the Clean Water Act. NDEE hereby incorporates this public notice as its own public notice and procedures by reference thereto. For purposes of NDEE, this public notice will expire 30 days from the issue date shown above. The purpose of this public notice is to solicit comments from the public regarding the work described below: The overall project purpose, as stated in the application, is to upgrade an existing segment of US-275 from Wisner to West Point to current expressway standards to provide a safe and efficient roadway to accommodate existing and future traffic volumes. The attached drawings provide additional project details.

  • Special Public Notice for Special Emergency Processing Procedures under E.O. 14156 in Montana, Nebraska, North Dakota, South Dakota, and Wyoming for Section 10 Rivers and Harbors Act and Section 404 Clean Water Action Permits

    The purpose of this notice is to advise the public that the U.S. Army Corps of Engineers (USACE), Northwestern Division has approved the use of special emergency processing procedures by the Omaha District in accordance with 33 CFR § 325.2(e)(4) for activities covered by the National Energy Emergency declared in Executive Order (EO) 14156. That EO was issued on January 20, 2025, under the President’s legal authorities, including the National Emergencies Act (50 U.S.C. §§ 1601 et seq.) and 3 USC § 301. For the reasons stated in Section 1 of EO 14156, the President has found that insufficient energy production, transportation, refining, and generation constitutes an unusual and extraordinary threat to our Nation’s economy, national security, and foreign policy and declared a national emergency on the basis of those findings. The President has directed agencies to use, to the fullest extent possible and consistent with applicable law, emergency USACE permitting provisions to facilitate the Nation’s energy supply.

    The U.S. Army Corps of Engineers, Omaha District is soliciting comments regarding the proposed Quick Current Broadband, Omaha Tribe of Nebraska, National Telecommunications and Information (NTIA) Decatur Project. USACE Omaha District has determined that the Quick Current Broadband Project would entail an alteration to the federal project, and therefore requires permission under Section 408. The project proposes construction of broadband cables underneath the Missouri River.
