    The U.S. Army Corps of Engineers is soliciting comments from the public regarding the City of Omaha, F Street Reconstruction. In compliance with USC Title 33, Chapter 9, Subchapter 1, Section 408, the City of Omaha Public Works (Requester) has requested permission from the U.S. Army Corps of Engineers (USACE) for an alteration at the Zorinsky Lake Project (Papillion Creek and Tributaries Lakes, Site 18) (Federal Project).

    This public notice is issued jointly by the U.S. Army Corps of Engineers, Omaha District, and the Nebraska Department of Environment and Energy (NDEE), 245 Fallbrook Blvd, Lincoln, NE 68521. NDEE will review the proposed project for state certification in accordance with the provisions of Section 401 of the Clean Water Act. NDEE hereby incorporates this public notice as its own public notice and procedures by reference thereto. Stillwater Lake Estates, LLC proposes to convert agriculture ground into a lake and mixed-use development, including medium density residential and commercial development located with the zoning jurisdiction of the City of Valley, Nebraska. The proposed project involves the construction of an approximate 32-acre private residential lake, 364 lots of medium-density housing, and 38 acres of commercial use. The authorization of this project will include grading and excavation/fill for residential lots, paved roads, sidewalks, entrances, water, sanitary, and sewer lines.

    The purpose of this Regional General Permit (RGP) is to authorize discharges into irrigation ditches that have minimal individual or cumulative adverse effects on the aquatic environment but that do not qualify for the Clean Water Act section 404(f)(1)(C) exemption because of the recapture provision at section 404(f)(2) (see 33 CFR 323.4) or do not qualify for a Nationwide General permit. For additional information regarding the application of exemptions, please refer to the Memorandum to the Field on Exemptions from Regulation under Section 404(f)(1)(C) of the CWA for the Construction or Maintenance of Irrigation Ditches and for the Maintenance of Drainage Ditches (Attachment A). LOCATION: This RGP is applicable to waters of the U.S., including wetlands, in the State of Nebraska within the Omaha District Regulatory Branch area of responsibility, including tribal lands.
