Based on the available information, the overall project purpose is to construct a road crossing in the Harvest Creek Development that satisfies the City of Sioux Falls’ public infrastructure requirements. The applicant’s project purpose, as stated in the application, is to provide public infrastructure for housing needed in a rapidly developing city.

    Yellowstone Mountain Club is proposing work at two locations for this permit request. The first location is at lifts tower 5 & 6 of the American Spirt ski lift and the second location is near Ranch 5. Approximately 0.22 acres of emergent wetland and 40 linear feet of an intermittent stream channel will be permanently impacted from the proposed actions. An estimated 0.19-acre of wetland and 40 linear feet (0.002-acre) of non-wetland waters of the U.S. will be permanently impacted through the proposed installation of a belowground drainage pipe system designed to reroute subsurface flows at the American Spirit project area. This action is needed in order to stabilize two ski lift towers. In addition, an estimated 0.03-acre of jurisdictional wetland will be permanently impacted during the construction of an asphalt driveway at Ranch 5.

    The District Engineer has received a prospectus from Ducks Unlimited, Inc, (Sponsor) titled, “Vermillion River ILF Project – Prospectus”, hereon referred to as the Prospectus. The Sponsor is obligated to develop a compensatory mitigation site to fulfill 108.84 advance wetland credits (Functional Capacity Units) that have been sold under the Ducks Unlimited In-Lieu-Fee Program (DU ILF). The Mitigation Site is located at Latitude 42.8585°, Longitude -96.8953°; Clay County, South Dakota. Credits sold under the DU ILF have been used to satisfy the compensatory mitigation requirements of DA authorizations issued for projects impacting waters of the United States located in the Vermillion River watershed. The Sponsor has secured a 256-acre parcel of land located adjacent to the Vermillion River, hereon referred to as the Mitigation Site. The stated objective of the Sponsor is to restore approximately 80 acres of wetland (HGM Class: Riverine) within the overall Mitigation Site. If the Mitigation Site is successful and produces more released credits than the number of advance credits that must be fulfilled, the Sponsor may request that the surplus credits be made available to satisfy the mitigation requirements of future DA authorizations.

    The U.S. Army Corps of Engineers, Omaha District, (USACE) is evaluating a request by Montana Aquatic Resources Services (MARS) to add an In-Lieu Fee (ILF) compensatory mitigation site to the Program’s Instrument, updated in May 2020. The Proposed Site Plan (Plan) is the first phase of mitigation site evaluation. It is intended to determine whether the site has enough potential to warrant development of a more detailed Draft Mitigation Site Plan. This notice is to inform interested parties of the proposed activity and to solicit comments. The proposed mitigation site would cover the Flathead Watershed.

The UMBI would cover the Kootenai (1), Upper Clark Fork (2), Lower Clark Fork (3), Flathead (4), St. Mary (5), Missouri-Sun-Smith (7), Marias (8), and Musselshell (10) major watersheds. This notice is to inform interested parties of the proposed activity and to solicit comments.
