    Great States Constructions, Inc. is proposing to permanently discharge fill material into 3.03- acres of wetlands in order to construct a storm water management pond, paved area, and a building associated with the Sioux Falls Distribution Center. Based on the available information, the overall project purpose is to provide a development for general distribution and light manufacturing in Sioux Falls, South Dakota. The applicant’s project purpose, as stated in the application, is to establish a distribution center for general distribution and light manufacturing. The site is located southwest of the intersection of Marion Road and Interstate Highway 90, just outside the northwestern city limits of Sioux Falls and is comprised primarily of cultivated agricultural land. There are approximately 3.79 acres of wetlands within the project area.

The purpose of this study is to evaluate alternatives for shoreline protection to reduce the continued loss of land which is threatening natural resources near the town of Lower Brule.

  • Special Public Notice for EMERGENCY PROCEDURES FOR PERMITTING IN MONTANA AND WYOMING FOR JUNE 2022 FLOODS

    The U.S. Army Corps of Engineers, Omaha District, (Corps) is issuing this public notice to inform members of the public of Section 404 of the Clean Water Act (Section 404) and Section 10 of the Rivers and Harbors Act of 1899 (Section 10). The Corps administers the permitting process for activities in waters of the United States and when activities occur over, in, or under a Section 10 water. This public notice explains when the Corps has jurisdiction over work or activities, what types of Department of Army (DA) permits are available, and how to apply for those permits. Specific emphasis is on emergencies and the permitting process for emergency activities in Montana and Wyoming. An “emergency” is a situation which would result in an unacceptable hazard to life, a significant loss of property, or an immediate, unforeseen, and significant economic hardship if corrective action requiring a permit is not undertaken within a time period less than the normal time needed to process the application under standard procedures. See 33 CFR 325.2(e)(4).

    On December 27, 2021, the U.S. Army Corps of Engineers published a final rule in the Federal Register (86 FR 73522) announcing the reissuance of 40 existing nationwide permits (NWPs) and one new NWP, as well as the reissuance of NWP general conditions and definitions with some modifications. These 41 NWPs will go into effect on February 25, 2022, and they will expire on March 14, 2026.
