    The U.S. Army Corps of Engineers, Omaha District, (Corps) is evaluating a permit application from Nebraska Department of Transportation to construct the U.S. 275, Norfolk to Wisner project, which would result in the discharge of fill material into 9.88 acres of waters of the United States, including wetlands. The project site is located at center point, Latitude 42.018543°, Longitude 97.053969°; along a 16-mile segment of US-275 in Stanton and Cuming Counties, Nebraska. The project begins 0.30 miles west of the US-275 and N-57 junction and extends east to 17th street in Wisner, Nebraska.

    The District Engineer has received a prospectus from the Sponsor titled, “The Papio-Missouri River Natural Resources District (Papio NRD) ILF Program – Prospectus”, hereon referred to as the Prospectus. The Corps is soliciting comments on the Prospectus. The Prospectus described herein is not being proposed by the Corps, but by the Sponsor. The Corps will evaluate the Prospectus according to the requirements of the Mitigation Rule (33 CFR 332) to determine if the Prospectus has the potential to produce compensatory mitigation suitable to offset unavoidable impacts to waters of the United States authorized through the issuance of Department of the Army (DA) permits pursuant to section 404 of the Clean Water Act (33 U.S.C. 1344) and/or sections 9 or 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 401, 403).

    The Papio-Missouri River Natural Resources District is proposing the construction of a regional detention basin (WP-1), dam structure, auxiliary spillway, and sediment basin on Whispering Ridge Creek, in the North Branch West Papillion Creek-West Papillion Creek HUC 12 (102300060101). The applicant’s project purpose is to provide long term flood damage reduction within the West Papillion Creek sub-watershed so that there is no increase in the extent of the 100-year floodplain as currently mapped by FEMA. The basic project purpose, as defined by the Corps, is flood reduction. The overall project purpose, as defined by the USACE, is flood reduction within the North Branch West Papillion Creek-West Papillion Creek HUC 12 watershed.
