The Omaha District of the U.S. Army Corps of Engineers (Corps) has received a mitigation bank prospectus from Plains Mitigation, LLC pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344). The purpose of this public notice is to evaluate the potential of the proposed Kota Mitigation Bank site to adequately compensate for wetland and stream impacts associated with Department of the Army permits pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344) and/or Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. §403). The project would affect waters of the United States associated with wetlands adjacent to Oakwood Lakes. The project area is located in the East Half of 17 Section, 112N Township, 51W Range; at Latitude 44.5066° and Longitude -96.9708°; approximately 6 miles northwest of Bruce, Brookings County, South Dakota.
