Published June 5, 2025
Expiration date: 7/6/2025
The U.S. Army Corps of Engineers, Omaha District, (USACE) is evaluating a request by Montana Freshwater Partners (MFP) to add an In-Lieu Fee (ILF) compensatory mitigation site to the Program’s Instrument, updated in December 2021. The purpose of this public notice is to evaluate the potential of this proposed site plan to adequately compensate for stream and wetland impacts associated with Department of the Army permits pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344) and/or Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. §403). The project proposes to restore and rehabilitate wetlands associated with Kings Creek, Kade Creek and Fowler Coulee. The project area is located at Deep Creek Ranch, approximately 15 miles west of the town of Choteau, in Teton County, Montana.
