The Omaha District provides Regulatory (Section 404 and Section 10) oversight for all or part of six states below. The Omaha District Section 408 program oversees alterations to USACE civil works projects within the Omaha District civil works area of responsibility.

The Omaha District of the U.S. Army Corps of Engineers (Corps) has received a mitigation bank prospectus pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344). The proposed Nelson Bank would be a private wetland mitigation bank which would allow the bank sponsor to develop and sell wetland credits within a defined service area. Wetland credits would be created through the restoration (re-establishment), enhancement, and preservation of wetlands adjacent located within the Lower Big Sioux drainage area. The wetland mitigation credits could be used to offset compensatory mitigation requirements associated with unavoidable impacts to waters of the United States authorized by Department of the Army (DA) permit requirements.
