The District Engineer (Omaha) is proposing to reissue Regional General Permit 96-01. The current version authorizes work undertaken in response to flooding. The reissuance would expand coverage to include work undertaken in response to any natural disaster. Authorized activities would include, but are not limited to: Repair or reconstruction of existing roads, including grade raises; temporary levee construction; levee repair; breach closures; bridge embankment repair; protection and/or repair of utility structures; placement of suitable rock and/or dirt fill for bank stabilization that does not include construction of jetties, hardpoints or other flow deflection structures or fills; construction of temporary drainage ditches to facilitate the removal of flood water, sheetwater, or excess water; repair or reconstruction of previously authorized drainage ditches with minor modifications that do not facilitate additional drainage; channel restoration limited to areas damaged by the disaster; and dredging/excavation necessary to restore water flow to existing intake systems or recreational access to existing marinas or bays with no associated discharge of dredged spoils. The RGP would cover work requiring authorization under either Section 10 of the Rivers and Harbors Act or Section 404 of the Clean Water Act anywhere in North Dakota.
