SPECIAL PUBLIC NOTICE: North Dakota Regional Conditions, Required Best Management Practices and Water Quality Certification for the 16 Nationwide Permits Published in the Federal Register on January 13, 2021

On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published a finale rule in the Federal Register announcing the reissuance of 12 existing nationwide permits (NWPs) and four new NWPs, as well as the reissuance of NWP general conditions and definitions with some modifications. These 16 NWPs will go into effect on March 15, 2021 and will expire on March 14, 2026. The Corps, Northwestern Division (NWD), has finalized regional conditions and required best management practices applicable in North Dakota. In addition, NWD has accepted Section Water Quality Certifications for the 16 NWPs provided by the US Environmental Protection Agency for work on Indian Lands and by the North Dakota Department of Environmental Quality for all other lands in North Dakota.
