The U.S. Army Corps of Engineers (Corps), Omaha District proposes to issue Regional General Permit (RGP) 23 for discharges of dredged or fill material into irrigation ditches and associated wetlands that have minimal individual or cumulative adverse effects on the aquatic environment but that do not qualify for the Clean Water Act section 404(f)(1)(C) exemption because of the recapture provision at section 404(f)(2) (see 33 CFR 323.4) and do not qualify for a Nationwide General permit. The Corps proposes to issue this RGP for a period of five (5) years. The purpose of this public notice is to inform the public, Indian Tribes, federal, state and local agencies/officials, and other interested parties of a 21-day comment period in which written comments may be submitted to the Corps. Written comments must be postmarked by June 20, 2023, prior to closure of the public notice administrative record.

Special Public Notice for EMERGENCY PROCEDURES FOR PERMITTING IN MONTANA AND WYOMING FOR JUNE 2022 FLOODS

The U.S. Army Corps of Engineers, Omaha District, (Corps) is issuing this public notice to inform members of the public of Section 404 of the Clean Water Act (Section 404) and Section 10 of the Rivers and Harbors Act of 1899 (Section 10). The Corps administers the permitting process for activities in waters of the United States and when activities occur over, in, or under a Section 10 water. This public notice explains when the Corps has jurisdiction over work or activities, what types of Department of Army (DA) permits are available, and how to apply for those permits. Specific emphasis is on emergencies and the permitting process for emergency activities in Montana and Wyoming. An “emergency” is a situation which would result in an unacceptable hazard to life, a significant loss of property, or an immediate, unforeseen, and significant economic hardship if corrective action requiring a permit is not undertaken within a time period less than the normal time needed to process the application under standard procedures. See 33 CFR 325.2(e)(4).

Special Public Notice for Federal Register Notice

On December 27, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 73522) announcing the reissuance of 40 existing nationwide permits (NWPs) and one new NWP. These 41 NWPs will go into effect on February 25, 2022, and they will expire on March 14, 2026.
