Army Corps of Engineers seeks public comments on proposal to renew and revise nationwide permits
The U.S. Army Corps of Engineers announced today it is seeking comments on its proposal to renew and revise 52 nationwide permits for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. In addition, USACE is proposing to issue five new nationwide permits that pertain to authorizing seaweed mariculture activities, finfish mariculture activities, electric utility line and telecommunications activities, utility line activities for water and other substances, and water reclamation and reuse facilities.

Public meeting scheduled in Jamestown, N.D., on Pipestem Dam Safety Modification Study
The U.S. Army Corps of Engineers, Omaha District (Corps) will hold a public meeting on Wednesday January 16, 2019 to provide information on the Dam Safety Modification Study (DSMS) for Pipestem Dam in Stutsman County, North Dakota, which is located about four miles northwest of Jamestown, North Dakota.

Draft EA for Medina, North Dakota water and sewer infrastructure improvements available for comment
A draft environmental assessment for a proposal to improve the existing water and sewer infrastructure for the city of Medina, North Dakota, is currently available for public review. The draft EA evaluates the environmental impacts of replacing deteriorated water and sanitary sewer infrastructure on a city-wide basis.

U.S. Army Corps of Engineers grants Special Use Permit to Standing Rock Sioux Tribe
Today the U.S. Army Corps of Engineers (Corps) issued a Special Use Permit to the Standing Rock Sioux Tribe to use Federal lands managed by the Corps near Lake Oahe. Omaha District Commander, Col. John W. Henderson, informed Standing Rock Sioux Tribal Chairman Dave Archambault II, that the Tribe’s Spiritual gathering, located south of the Cannonball River, has been granted a Special Use Permit, which allows the Tribe to gather to engage in a lawful free speech demonstration on Federal lands designated in the permit.

USACE seeks public comments on proposal regarding nationwide permits
The U.S. Army Corps of Engineers announced it is seeking comments on its proposal to renew and revise 50 nationwide permits for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. In addition, USACE is proposing to issue two new nationwide permits that pertain to authorizing the removal of low-head dams and the construction and maintenance of living shorelines.

No decision yet regarding water crossings for Dakota Access Pipeline
The U.S. Army Corps of Engineers has not issued a decision in response to Dakota Access, LLC’s application for permits and permissions to construct and operate the Dakota Access Pipeline Project. The applicant has requested that USACE issue permits under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899 for water body crossings, as well as provide the permission required by Section 14 of the Rivers and Harbors Act of 1899, codified at 33 U.S.C. 408 (Section 408).
