Nationwide Permits

The 2021 Nationwide Permits (NWP) were published in the Federal Register January 13, 2021 and December 27, 2021. The January 13, 2021 Federal Register notice modified NWPs 12, 21, 29, 39, 40, 42, 43, 44, 48, 50, 51, and 52; and adding NWPs 55, 56, 57, and 58; with an effective date of March 15, 2021. The December 27, 2021 Federal Register notice reissued NWP 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14, 15, 16, 17, 18, 19, 20, 22, 23, 24, 25, 27, 28, 30, 31, 32, 33, 34, 35, 36, 37, 38, 41, 45, 46, 49, 53, and 54; and added NWP 59; with an effective date of February 25, 2022.

Nationwide Permits

Nationwide permits are a type of general permit issued by the Corps of Engineers. Nationwide permits are intended to regulate with little, if any, delay or paperwork certain activities having no more than minimal adverse environmental impacts. Per regulation, the Nationwide Permits must be reissued every five years. The reissuance process involves a full interagency and public review. Some Nationwide Permits require pre-construction notification to the Corps prior to proceeding with an activity.

Omaha District Nationwide Permit Information

With the publication of the 2021 NWPs in the Federal Register, reissuing 52 NWPs and issuing 5 new NWPs, the Northwestern division finalized regional conditions for these 57 NWPs. Regional conditions will provide additional protection for the aquatic environment and will help ensure that the NWPs authorize only those activities with no more than minimal adverse environmental effects. Regional conditions will help ensure protection of high value waters within the Omaha District. Clean Water Act (CWA) Section 401 Water Quality Certifications (WQC) have been issued for Section 404 NWP activities by the certifying authorities within the Omaha District area of responsibility. The WQCs were accepted by the Northwestern Division Commander and any conditions of the WQC are added to the 46 NWPs that require WQC as regional conditions.
