THE PURPOSE OF THIS PUBLIC NOTICE IS TO SOLICIT COMMENTS FROM THE PUBLIC REGARDING THE WORK DESCRIBED BELOW. A DECISION HAS NOT BEEN MADE REGARDING ISSUANCE OF PERMISSION AT THIS TIME.
PROJECT TITLE: Council Bluffs Riverfront Phase 5 Drilling and Invasive Program Plan (DIPP) (Section 408 Reference Number: 408-NWO-2025-0018).
REQUESTER: In compliance with USC Title 33, Chapter 9, Subchapter 1, Section 408, Thiele Geotech, Inc., on behalf of the City of Council Bluffs, IA (Requester) has requested permission from the U.S. Army Corps of Engineers (USACE) for an alteration at the Missouri River Levee Units L624-627 (Federal Project).
AUTHORITY: The authority to grant permission for temporary or permanent use, occupation, or alteration of any USACE civil works project is contained in Section 14 of the Rivers and Harbors Act of 1899, as amended, codified at 33 USC 408 (“Section 408”). Section 408 authorizes the Secretary of the Army, on the recommendation of the Chief of Engineers, to grant permission for the alteration or occupation or use of a USACE project if the Secretary determines that the activity will not be injurious to the public interest and will not impair the usefulness of the project. The Secretary of the Army’s authority under Section 408 has been delegated to USACE, Chief of Engineers. USACE, Chief of Engineers has further delegated the authority to USACE, Directorate of Civil Works and Division and District Engineers, depending upon the nature of the activity. An alteration is defined as any action that builds upon, alters, improves, moves, occupies or otherwise affects the usefulness, or the structural or ecological integrity of a Corps federally authorized project.
EVALUATION: USACE Omaha District has determined that the Indian Cave State Park Motorboat Access Improvement Project would entail an alteration to the Federal Project, and therefore requires permission under Section 408.
LOCATION: The proposed Council Bluffs Riverfront Phase 5 DIPP is located in Council Bluffs, IA near the Interstate 480 bridge. Boring locations (B1, B-2, B-3, B-4) are located at approximate center coordinates: latitude 41°15'35.07"N, longitude 95°54'59.90"W for B-4, B-5, B-6 and latitude 41°15'43.96"N, longitude 95°55'3.71"W for B-1.
REQUESTER’S PROPOSED ACTON: The proposed work consists of the advancement of 4 soil borings on the left bank of the Missouri River on the landside of the L624-627 levee system on the north (B-1) and south (B-4, B-5, and B-6) sides of the Interstate 480 Bridge. The borings will be advanced to depths of 20 to 25 feet below the ground surface within the levee embankment (B-1) and 95 to 350 feet away from the landside levee toe (B-4, B-5, and B-6). The borings are planned to be backfilled with a 70% water - 30% bentonite grout mixture which will be installed in lifts to prevent hydrofracturing. All borings will be grouted from the bottom of the boring to depths of 8 to 9 feet below the ground surface; after the first lift has set then a second lift will commence to the ground surface.
These borings are to gather subsurface data to inform the design of aspects of the Riverfront Phase 5 project which includes construction a new playground area near Council Bluffs Levee Road and the Interstate 480 bridge in Council Bluffs, Iowa. Additionally, a new monument will be constructed near the center of the Donor Plaza on the north end of the site. This 408 request (408-NWO-2025-0018) is solely for the above-described geotechnical borings (DIPP); any other modifications or construction related to the playground, monument, or other Riverfront Phase 5 components will be reviewed under separate 408 requests.
Only project elements that would alter the Federal Project are within the review scope for the Section 408 permission request. A portion of the proposed activities are located within the floodplain.
NATIONAL ENVIRONMENTAL POLICY ACT: USACE has determined an Environmental Assessment (EA) is appropriate to inform the anticipated effects to the quality of the human and natural environment from implementation of the proposed Section 408 project.
A Programmatic Environmental Assessment (PEA) & Finding of No Significant Impact (FONSI), for Categorically Permitted Alterations in the state of Nebraska and signed USACE Omaha District Commander Colonel John W.
