    This public notice is issued jointly by the U.S. Army Corps of Engineers, Omaha District, and the Nebraska Department of Environment and Energy (NDEE), 245 Fallbrook Blvd, Lincoln, NE 68521. NDEE will review the proposed project for state certification in accordance with the provisions of Section 401 of the Clean Water Act. NDEE hereby incorporates this public notice as its own public notice and procedures by reference thereto. Stillwater Lake Estates, LLC proposes to convert agriculture ground into a lake and mixed-use development, including medium density residential and commercial development located with the zoning jurisdiction of the City of Valley, Nebraska. The proposed project involves the construction of an approximate 32-acre private residential lake, 364 lots of medium-density housing, and 38 acres of commercial use. The authorization of this project will include grading and excavation/fill for residential lots, paved roads, sidewalks, entrances, water, sanitary, and sewer lines.

  • RGP 9202-07 (NWO-1992-22002-RWY)

    The U.S. Army Corps of Engineers (Corps), Omaha District proposes to reissue Version 7 of Regional General Permit 199222002 (RGP 9202-07). The permit would authorize construction of boat ramps and attendant features in waters of the United States located in Wyoming pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act of 1972 (U.S.C. 1344). This permit is applicable to jurisdictional waters of the United States within the State of Wyoming, including, but not limited to, rivers, lakes, and reservoirs for the purpose of providing access to the waterbody by watercraft. Certain waterways and aquatic resource types are given special consideration. The Corps proposes to reissue this RGP for a period of five (5) years.

  • RGP-2302-RWY (NWO-2023-00722-RWY)

    The District Commander, U.S. Army Corps of Engineers, Omaha District, has issued Version 1 of Regional General Permit 2302 (RGP-2302-RWY). The permit authorizes discharges of dredged or fill material into waters of the United States associated with ditch related activities in the state of Wyoming pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. § 403) and Section 404 of the Clean Water Act (33 U.S.C. § 1344).

  • REGIONAL GENERAL PERMIT 23 (RGP-23-NE)

    Expiration date: 11/30/2028

    The purpose of this Regional General Permit (RGP) is to authorize discharges into irrigation ditches that have minimal individual or cumulative adverse effects on the aquatic environment but that do not qualify for the Clean Water Act section 404(f)(1)(C) exemption because of the recapture provision at section 404(f)(2) (see 33 CFR 323.4) or do not qualify for a Nationwide General permit. For additional information regarding the application of exemptions, please refer to the Memorandum to the Field on Exemptions from Regulation under Section 404(f)(1)(C) of the CWA for the Construction or Maintenance of Irrigation Ditches and for the Maintenance of Drainage Ditches (Attachment A). LOCATION: This RGP is applicable to waters of the U.S., including wetlands, in the State of Nebraska within the Omaha District Regulatory Branch area of responsibility, including tribal lands.
  • NWO-2005-11212-WEH

    The Lower Platte South Natural Resource District (LPSNRD) is proposing the construction of a water quality basin (Piening Water Quality Basin), spillway, and dam structure within the Pawnee Lake and Middle Creek HUC 12 (102002030202) watershed as part of the LPSNRD Water Quality Management Plan (WQMP). The dam structure is an earthen embankment approximately 889 feet in length. The dam would create a reservoir with a normal pool surface area of approximately 12.2 acres at an elevation of 1,311 feet. The drainage basin area of the Piening Water Quality Basin would be approximately 512 acres. The applicant’s project purpose is to maximize reductions of Atrazine, phosphorus, nitrogen, and sediment loadings as a result of surface runoff from a contributing 524- acre subbasin of the Pawnee Lake and Middle Creek HUC 12 watershed per the LPSNRD WQMP. The basic project purpose, as defined by the USACE, is water quality management. The overall project purpose, as defined by the USACE, is water quality management within the Pawnee Lake and Middle Creek HUC 12 watershed.
