TO WHOM IT MAY CONCERN: The Omaha District of the U.S. Army Corps of Engineers (Corps) has received an application for a Department of the Army permit pursuant to Section 404 of the Clean Water Act (33 U.S.C. §1344) and/or Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. §403). This public notice is issued jointly with the Nebraska Department of Environment and Energy (NDEE), 245 Fallbrook Blvd, Lincoln, NE 68521. NDEE will review the proposed project for state certification in accordance with the provisions of Section 401 of the Clean Water Act. NDEE hereby incorporates this public notice as its own public notice and procedures by reference thereto. For purposes of NDEE, this public notice will expire 30 days from the issue date shown above. The purpose of this public notice is to solicit comments from the public regarding the work described below:

WATERWAY AND LOCATION: The project will affect waters of the United States associated with the Elkhorn River and adjacent wetlands. The project/review area is located on Road 6, approximately ½ mile S of the intersection of HWY 275 and Road 6 in Section 11, Township 23 North, Range 4 East; at Latitude 41.983589 and Longitude -96.922969; in Wisner, Cuming County, Nebraska.
