Published July 7, 2023
Expiration date: 7/27/2023
The U.S. Army Corps of Engineers (Corps), Omaha District, proposes to issue Regional General Permit (RGP) 23 for discharges of dredged or fill material into irrigation ditches and wetlands that have minimal individual or cumulative adverse effects on the aquatic environment but that do not qualify for the Clean Water Act section 404(f)(1)(C) exemption because of the recapture provision at section 404(f)(2) (see 33 CFR 323.4) or do not qualify for a Nationwide General permit. This permit is applicable to all jurisdictional Waters of the United States (U.S.), including wetlands, in the State of Nebraska within the Omaha District Regulatory Branch area of responsibility, including tribal lands. The Corps proposes to reissue this RGP for a period of five (5) years.
