Freedom of Information Act (FOIA)

What is a Freedom of Information Act (FOIA) request?

A Freedom of Information Act (FOIA) request is a written request for records made by any person, including a member of the public (U.S. or Foreign citizen), an organization, or a business, but not including a federal agency or a fugitive from the law that either explicitly or implicitly invokes the FOIA. The request must include a statement agreeing to pay the assessable fees associated with processing the request. There are three categories of FOIA requesters. They are as follows:

a. commercial - Requesters must agree to pay all search, review, and duplication costs.

b. educational or noncommercial scientific institution or news media - Requesters must agree to pay duplication charges in excess of the first 100 pages if more than 100 pages of records are desired.

c. all others - Requesters must agree to pay assessable search and duplication costs if more than two hours of search effort or 100 pages of records are desired.

Requesters may be required to pay in advance if the estimated cost of processing the request exceeds $250.00, or if the requester has previously failed to pay fees in a timely fashion.

The fees are as follows:

  • $44.00 per hour for professional search and review time
  • $20.00 per hour for clerical search and review time,
  • $0.15 for each side of a duplicated page; and
  • $52.00 for computer time.

A reply should be dispatched within 20 working days.
