    The District Engineer has received a prospectus from the Sponsor titled, “The Papio-Missouri River Natural Resources District (Papio NRD) ILF Program – Prospectus”, hereon referred to as the Prospectus. The Corps is soliciting comments on the Prospectus. The Prospectus described herein is not being proposed by the Corps, but by the Sponsor. The Corps will evaluate the Prospectus according to the requirements of the Mitigation Rule (33 CFR 332) to determine if the Prospectus has the potential to produce compensatory mitigation suitable to offset unavoidable impacts to waters of the United States authorized through the issuance of Department of the Army (DA) permits pursuant to section 404 of the Clean Water Act (33 U.S.C. 1344) and/or sections 9 or 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 401, 403).

    The U.S. Army Corps of Engineers, Omaha District, (USACE) is evaluating a permit modification for the second phase of a previously permitted bank stabilization project on the Yellowstone River. The proposed project modification includes the placement of 1,440 linear feet (LF) of native alluvium in an area containing streambanks averaging 5.5-foot-high cut banks of sandy loam soils overlaying river alluvium. This would result in a discharge of 2,070 cubic yards (CY) of fill material, below the ordinary high-water mark (OHWM) of the Yellowstone River. This would include the use of native alluvium excavated from a medial gravel bar within the project area. This excavation area is approximately 66,270 square feet. Large woody debris, consisting of cottonwood logs sourced from the gravel bar will be integrated into the proposed gravel revetment. The applicant will also install approximately 3,000 individual dormant willow cuttings into the bank slope to assist in the stabilization of the previously failed bank. The project would result in permanent impacts to approximately 2.04 acres of the Yellowstone River. This notice is to inform interested parties of the proposed activity and to solicit comments.

  • NWO-2012-00140-BIS, Ducks Unlimited Turtle Mountain In-Lieu Fee Mitigation Site

    The District Engineer (Omaha) is evaluating a site plan submitted by Ducks Unlimited, Inc. (DU) to add as an addendum to their North Dakota Aquatic Resource In-Lieu Fee Program Instrument approved on March 5, 2014. The Turtle Mountain In-Lieu Fee Mitigation Site (Site) is located one mile west of Willow Lake National Wildlife Refuge and 10 miles northeast of Dunseith in the NE¼ of Section 13 and NE¼ of Section 24, Township 163 North, Range 74 West at Latitude 48.93583° North, Longitude -100.18822° West, Bottineau County, North Dakota. DU estimates that the Site would generate 38.53 credits. Credits would be achieved primarily through restoration of wetlands, with additional credits for enhancement, creation and preservation of wetlands and minimal credit for uplands. The Regional Service Area for the Site would be the Souris River Basin Zone.

    The District Engineer (Omaha) is evaluating a site plan submitted by Ducks Unlimited, Inc. (DU) to add as an addendum to their North Dakota Aquatic Resource In-Lieu Fee Program Instrument approved on March 5, 2014. The Kruschwitz In-Lieu Fee Mitigation Site (Site) is located in Section 4, Township 158 North, Range 98 West at Latitude 48.534267° North, Longitude -103.348732° West, Williams County, North Dakota. DU estimates that the Site would generate 40.93 credits. Credits would be achieved primarily through restoration of wetlands, with additional credits for enhancement, creation and preservation of wetlands and minimal credit for uplands. The Regional Service Area for the Site would be the Missouri North Zone.

    The District Engineer (Omaha) is evaluating a site plan submitted by Ducks Unlimited, Inc. (DU) to add as an addendum to their North Dakota Aquatic Resource In-Lieu Fee Program Instrument approved on March 5, 2014. The Crowder In-Lieu Fee Mitigation Site (Site) is located 6 miles south of the Lostwood National Wildlife Refuge and northeast of Stanley in Section 25, Township 157 North, Range 92 West at Latitude 48.398741° North, Longitude -102.509168° West, Mountrail County, North Dakota. DU estimates that the Site would generate 29.41 credits. Credits would be achieved primarily through restoration and enhancement of wetlands with minimal credits for surrounding uplands. The Regional Service Area for the Site would be the Missouri North Zone.
